Chapter 3. Amendments to the Faculty Handbook

3.1
The Handbook shall be amended on a biennial basis according to the following process: 3.1.1
In academic years beginning with an odd-numbered year, proposals to amend the Handbook must first be presented to the Faculty Governance Committee for consideration. 3.1.1.1
Proposals to the Faculty Governance Committee may come from the Board of Trustees or administration through the CAO, standing or special faculty committees, or academic departments. 3.1.1.2
Proposals should include the: 3.1.1.2.1
specific/suggested section to be amended; 3.1.1.2.2
concern with current written language and rationale for amendment; 3.1.1.2.3
suggested addition, replacement, and/or deletion of language. 3.1.1.3
If the Faculty Governance Committee accepts the proposal, it will be incorporated into a draft of the Handbook and presented as a motion from committee for conditional approval at the next allowed regular meeting of the faculty. 3.1.1.3.1
Motions for conditional approval may be made at any regular meeting of the Faculty, prior to the January meeting. 3.1.1.3.2
Motions for conditional approval must be disposed of like any other motion and conditional approval requires a majority vote of the Faculty. 3.1.1.3.3
If a proposal is not accepted by the Faculty Governance Committee, the motion, vote, and proposal is sent as an FYI to the next regular faculty meeting, in case broader consideration is warranted. 3.1.1.4
Amendments receiving conditional approval are developed as proposals in the Modern Campus Curriculum platform (Modern Campus), if they are not already in that format. They are then reviewed and approved in Modern Campus by the Faculty Governance Committee and presented as a motion for recommendation for adoption at the next regular meeting of the faculty. Such a motion must be approved by a majority vote of the voting membership of faculty holding voting rights as defined in Chapter 2 of the Faculty Bylaws held at (or shortly following) the meeting. 3.1.1.5
If the motion for adoption is approved, the chair approves the proposals in Modern Campus. This moves them forward for consideration in Modern Campus by the CAO, and subsequently the President, each of whom may approve or deny the proposals, though it is expected that consultations will take place as needed to discuss issues or concerns. 3.1.1.5.1
A denial at any stage requires the process to start over at the level of the originator of the Modern Campus proposal. 3.1.1.5.2
The President may initiate a legal review as part of this process. If a legal review is not initiated, or if one is and there are no recommendations resulting from legal review, and the President approves the proposals, they are moved forward for ultimate consideration by the Board of Trustees. 3.1.1.5.3
Recommendations from legal review that need to be addressed trigger a denial and are passed as soon as possible back to the chair of the Faculty Governance Committee, who will work with the committee and others as needed to address the recommendations and present any changes as a revised Modern Campus proposal following the process beginning in 3.1.1.4 above. 3.1.1.6
Board decisions regarding amendments to the Handbook shall be communicated back to faculty through the Office of the President within 30 days from the meeting at which the decision was made. Amendments will not take effect unless adopted by the Board of Trustees. 3.1.2
In academic years beginning with an even-numbered year, a need to amend the Handbook on a timelier basis may arise. Proposals to amend the Handbook in this manner must first be presented to the Faculty Governance Committee and the CAO for consideration. 3.1.2.1
Proposals to the Faculty Governance Committee may come from the Board of Trustees or administration through the CAO, standing or special faculty committees, or academic departments. 3.1.2.2
Proposals should include the: 3.1.2.2.1
specific/suggested section to be amended; 3.1.2.2.2
concern with current written language and rationale for amendment, including why such an amendment cannot wait until the next biennial review; 3.1.2.2.3
suggested addition, replacement, and/or deletion of language. 3.1.2.3
If the Faculty Governance Committee, in collaboration with the CAO, accepts the proposal, the process outlined beginning in 3.1.1.3 above will be followed. 3.1.2.4
Nothing precludes potential amendments to the Handbook from being discussed and endorsed in academic years beginning with an even-numbered year, but only through the process outlined beginning in 3.1.2 may amendments be implemented. |
